It should be noted that, with provision dated 24 June 2020, the Judge Delegated to the procedure, authorized the Curatorship to "stipulate with OMISSIS a settlement deed which grants the latter company the possibility of temporarily and precariously holding, with the obligation to custody and with exclusive liability, also towards third parties, for the company branch owned by the Curatorship, with the occupant's waiver of the fair compensation provided for by Article 79 of the Finance Law, until the definitive award of the lease , to be declared, against whoever is entitled to it, pursuant to art. 104 bis of the Finance Law and with the obligation to release the company within and no later than 90 days from the successful awarding, with the provision of a suitable penalty in case of delayed release of the company".
